Before proceeding to VCAT, parties are required in most circumstances to participate in a mediation conducted by the Small Business Commissioner's (SBC's) Office at a heavily subsidised cost by the taxpayer.
Whilst VCAT is designed to be an informal jurisdiction, don't be fooled. Parties need to be prepared and seek the right advice. VCAT has the jurisdiction to determine a variety of cases and almost exclusive jurisdiction to hear and determine all Retail Lease Disputes in Victoria.
Its decisions are as binding as a court decision and it has a dedicated list dealing with Retail Lease Disputes. Information regarding the operation of the list can be found at the VCAT website
VCAT's members are experienced in dealing with Retail Lease Disputes and are familiar with the issues that arise between Landlord and Tenant
Importantly, VCAT is generally a no costs jurisdiction which means that parties must pay their own costs, win or lose
